Apsiyon Bilişim Sistemleri San. ve Tic. A.Ş. information notice for prospective employees on the protection and processing of personal data

1. Preamble

This Information Notice is issued in accordance with Article 10 of the PDP Law for the purposes of informing the Prospective Employees of Apsiyon Bilişim Sis. San. ve Tic. A.Ş. (“Company”), in regards to the Personal Data collected and processed by the Company as well as the Employees' rights set forth in the Personal Data Protection Law No. 6698 (PDP Law). Your personal data shall be retained for the retention periods specified in the applicable legal legislations and during the period required for the following processing purposes, and thereafter they shall be completely deleted, destroyed or anonymized pursuant to the PDP Law.

2. Processing of Personal Data

Our Company records and processes your personal data printed and/or wet signed or electronically, shown in the following categories, contained in the job application form, your resume and other documents you have provided us, in order to contact you for the vacant positions in our company that we think may be suitable for you, to fulfill our legal obligations, to plan our administrative and personnel affairs, to conduct our Company's processes in accordance with the law and our company policies:

  • Credentials
  • Contact
  • Physical Space Security
  • Professional Experience
  • Visual and Audio Records
  • Association Membership (It will only be processed if provided by you.)
  • Foundation Membership (It will only be processed if provided by you.)
  • Union Membership
  • Health Information
  • Other Information (Marital status, military service and education status, driver's licenses, etc.)

In addition to the foregoing purposes, your personal data may be shared with the companies from which we receive service and consultancy to duly and legally execute our Company processes by ensuring their efficiency. Furthermore, we are able to share your personal data with official authorities, if necessary, in order to fulfill our legal obligations. However, your health-related data may not be shared with any person or entity in any way unless you are recruited.

Personal data are collected, utilized, recorded, stored and processed by our Company by an explicit and apprehensible notice to the relevant persons, by obtaining their explicit consent, if necessary, in accordance with law and good faith, in connection with and limited to the legitimate purpose expressly stated above and under the principle of proportionality. Your personal data are processed in accordance with Article 5/2/a of the PDP Law and other provisions of the law in particular as per the requirements of the Labor Law and Occupational Health and Safety legislation and transferred to the foregoing persons and entities. Besides this, your personal data are processed on the following legal grounds set forth in Article 5/2 of the PDP Law and shared with the foregoing persons and entities:

  • It is necessary in order to protect the life or physical integrity of the data subject or another person where the data subject is physically or legally incapable of giving consent or whose consent is not deemed legally valid.
  • Processing of personal data of the parties of a contract is necessary provided that it is directly related to the establishment or performance of the contract.
  • It is necessary for the data controller to be able to fulfill his legal obligations.
  • It is made available to the public by the data subject himself.
  • Data processing is necessary for the establishment, exercise or protection of any right.
  • Data processing is necessary for the legitimate interests of the data controller, provided that it shall not violate the fundamental rights and freedoms of the data subject.

Your personal data will be retained for the continuation of the employment relationship if the recruitment process ends up with a successful outcome. If the recruitment process ends up with an unsuccessful result, your personal data will be retained for a period of 2 (two) years so that we can consider you as a prospective employee at a later time. Your personal data shall be deleted, destroyed or anonymized pursuant to the PDP Law at the end of the retention periods specified in the relevant legal regulations. In this context, your personal data retained by our Company itself, will be destroyed at the first periodic destruction period following the expiration of 2 (two) years of your application or upon your request; however, our Company does not make any commitment as to the periods of the destruction of third parties if you have lodged your application through a third person.

Your personal data are processed and retained in order not to be subjected to unauthorized access, lost or harmed in the environments in which they are processed and stored, provided that they are only used for the specified purpose and scope, by being encrypted if and when necessary, in a way accessible only to authorized persons, and by taking all other necessary information security measures.

3. Rights of Prospective Employees

By applying to the Company in accordance with Article 11 of the PDP Law, you have the right to,

  • Learn whether your personal data are being processed,
  • If so to request information with respect to this,
  • Learn the purpose of personal data processing and whether the data are used for the intended purposes,
  • Request rectification in case personal data are processed incompletely or inaccurately,
  • Request their deletion or destruction under the conditions provided for in article 7 of the Law,
  • Object to the occurrence of a result which is detrimental to you as a result of your processed personal data being analyzed exclusively through automated systems,
  • Request compensation for your damages arising due to the unlawful processing of your personal data

In order to exercise these rights, as per Article 13 of the PDP Law, you can submit a written application to the address of the Company below by adding your name, surname, signature, T.R. identification number if you are a Turkish national, and your nationality, passport number, or if any, your identification number if you are a foreign national, residence or workplace address of correspondence, your contact email address and telephone number, the reason for your application and attaching other necessary information and documents for identification. Your application will be evaluated by the Company and will be concluded free of charge within thirty days.
